Privacy Policy

Who we are

“Tenthill Rise” (we, us, our) operates the website tenhillrise.au for the developer. We work with Urban Land (our real estate agent) and Property Gateway (our development partner) to market lots, handle Expressions of Interest (EOIs), reservations, and coordinate contract preparation.

This Policy is written to comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

The information we collect

1. Information you give us via our formsIn the course of your visits to our website or use of our products and services, we may obtain the following information about you: name, company name, email address, telephone number, geographic location, IP address, survey responses EOIs, queries, blog comments and social media handles. In particular we collect the fields shown on our website forms, including:

  • “Register Your Interest” form (lead enquiry) including:
    • First Name (required)
    • Last Name (required)
    • Email (required)
    • Mobile (required)
    • Lot Preference (if provided)
  • EOI / Reservation form (progressing a purchase) including:
    • Applicant(s): Title, First/Middle/Surname (Applicant 1 required; Applicant 2 optional)
    • Purchasing Entity & Address: Entity name; Address Line 1/2; Suburb; State/Region; Postcode; Country
    • Main Contact: Mobile (required); Office/Home (optional); Email (required)
    • Solicitor / Conveyancer: Firm; Contact; Address; Mobile; Office; Fax; Email
    • Property Preferences: Lot Preference 1–3 (required), Comments, Special Conditions
    • Signatures: Applicant names, signatures and dates
    • Reservation mechanics: We provide independent trust account details for EFT deposit. You email an EFT receipt. We do not process card/bank details on our site.
  • Contract input information including details you (or your solicitor) submit so we can prepare a contract of sale, e.g., buyer entity, authorised signatories, special conditions, and settlement instructions.
  • Communications & interactions including Emails, phone notes, meeting records with our team/agent, plus your marketing preferences.
  • Technical & usage data including basic analytics/cookies, device/browser, IP address, pages viewed, session stats.

We do not actively seek sensitive information. If necessary and permitted by law, we will obtain consent first.

How we collect personal information

We may collect personal information:

  • Directly from you via tenthillrise.au web enquiry forms (Register Your Interest, EOI/Reservation) and email/phone;
  • From your authorised representatives (e.g., solicitor, buyer’s agent, co-purchaser);
  • From our sales agent Urban Land and development partner Property Gateway as part of a unified sales workflow;
  • Automatically via cookies/analytics when you browse our site.

Why we collect, use and disclose personal information

We collect, hold, use and disclose personal information for purposes required or permitted by law and which are reasonably necessary for our business activities. Those purposes include:

  • Registering your interest and manage EOIs and Lot Reservations;
  • Communicating lot availability, pricing ranges and project updates;
  • Prepare draft contracts of sale and coordinating with your solicitor/conveyancer;
  • Administering the sales process through construction, plan sealing, title registration and settlement;
  • Operating and improving our website and maintain records;
  • Complying with Australian laws, manage risk and otherwise meet our legal and regulatory requirements;
  • Sending project updates/marketing to you including for other projects that may be of interest to you (you can opt out at any time);
  • The purpose for which the personal information was initially collected (including sharing with related entities);
  • A purpose related to the initial purpose of collection if that other purpose would be within the individual’s reasonable expectations (or the individual’s consent is first obtained); and
  • To deal with complaints.

Disclosures: who we share information with (and why)

  • Urban Land (real estate agent) for enquiries, EOIs, reservations, inspections and contract progression;
  • Property Gateway (development partner) for project marketing operations and communications;
  • Your solicitor/conveyancer, our external legal advisers, and the independent trust account law practice noted in reservation information (payments occur off-platform by EFT);
  • Our Australian IT/hosting, email and data-storage providers;
  • Professional advisers (auditors, accountants, insurers);
  • Utilities, titles office and government authorities where required for plan sealing, title registration and statutory processes;
  • Courts/tribunals/regulators where required or authorised by law.

We do not sell or deal in personal information or any customer information.

Where your data is stored (data residency) & overseas disclosures

All website hosting and primary data storage are located in Australia. We do not routinely disclose or transfer personal information outside Australia. If an overseas disclosure becomes necessary (e.g., a specialist service engaged in future), we will take reasonable steps to ensure compliance with the APPs and will update this Policy accordingly.

Your rights and choices

  • Access & correction: You may request access to, or correction of, your personal information—contact us using the details below. We’ll respond within a reasonable time and explain any lawful refusal. We will need to verify the individual’s identity before giving access and we may levy an administration fee for providing access. To seek the correction or access, please contact our Privacy Officer using the contact details at the end of this Privacy Policy.
  • Marketing opt-out: Use the unsubscribe link in our emails or contact us to opt out.
  • Optionality: If you choose not to provide required fields (e.g., Register Your Interest basics or EOI minimums), we may be unable to progress your enquiry or reservation.

Security and retention

We use reasonable technical and organisational measures to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. No method is 100% secure. We retain information only as long as needed for the purposes above and to meet legal/record-keeping requirements (e.g., contract and titles queries).

Cookies

Our site uses cookies/analytics to improve performance and understand visits. You can manage cookies in your browser; some features may not work if cookies are disabled. We do not process payment card/bank details on the website; any reservation deposit is paid by EFT off-platform to an external trust account, with EFT receipt emailed to us.

Third-party links

Our website may link to other sites (e.g., council or regional information). We are not responsible for their privacy practices—please review their policies.

Children

Our project and forms are intended for business and adult purchasers. We do not knowingly collect personal information from anyone under 18. If we become aware that a child under 18 has provided us with personal information, we will delete that information as quickly as possible. If you are the parent or guardian of a child and you believe they have provided us with personal information without your consent, then please contact us.

Changes to this Policy

We may modify this policy at any time, in our sole discretion and all modifications will be effective immediately upon our posting the new version on tenthillrise.au. Please review this privacy policy periodically.
